Operator Terms of Use
Last updated
Introduction and acceptance
These Operator Terms of Use ("Terms") are an agreement between the organization or individual that enrolls as an operator ("you") and FltLvl 410 LLC ("FLTLVL410", "we", "us"). They govern your access to the FLTLVL410 operator workspace, which lets you post trips, review and hire pilots, and communicate with them (together, the "Platform"). By creating an operator account or using the workspace you agree to these Terms and to our Privacy Notice on behalf of the operator you represent.
If you do not agree to these Terms, do not use the Platform. We may change the Platform from time to time, including its features, integrations, eligibility requirements and fees.
Our role; not an air carrier or charter broker
FLTLVL410 is a technology platform that helps operators post trips and helps pilots find them. We are not an air carrier, charter broker or employer of any pilot, and we do not operate, dispatch, schedule or control any flight.
You are responsible for the trips you post, for deciding which pilots to hire, and for releasing and conducting each flight. Our verification checks do not replace the vetting that you owe before approving a crew member or a flight.
Eligibility and authority
You confirm that you are at least 18 years old, that you have authority to bind the operator you enroll, and that the information you give us is accurate and complete. You agree to complete the onboarding and verification checks we publish for operators.
Our onboarding does not replace any filing, certificate, authorization or insurance that regulators, airports or other parties require for the trips you post. You are responsible for holding and keeping them current.
Account registration and security
You are responsible for keeping your sign-in details and devices secure, for turning on multi-factor authentication when it is offered, for everyone you allow to use your workspace, and for everything done through your account. Tell us promptly at support@fltlvl410.com if you think your account has been compromised.
Keep your company details, fleet and documents up to date. Inaccurate or misleading information can lead to suspension of your account or listings, because pilots rely on it when they apply.
Fleet, listings and trip postings
Post accurate fleet details and trip information, including dates, routes, aircraft, seat and position requirements, compensation and any travel, ground or other arrangements a pilot should expect before they apply.
If a trip changes or is cancelled, update or cancel it in the Platform straight away so that pilots can rely on what they see. Cancellations are subject to our Cancellation Policy.
Hiring pilots and operational control
A hire is made when you accept a pilot's application through the Platform. Pilots use the Platform as independent contractors of the operator that hires them, and you are responsible for how you engage and direct them.
You remain solely responsible for operational control of each flight, for the qualifications, currency and medical status of the crew you assign, for insurance, and for compliance with aviation regulations that apply to the trip. Information we show about a pilot, including verification results and background check outcomes, is an aid to your own decision and not a guarantee.
Fees and payments
Payments are processed by a third-party payment processor. By adding a payment method and hiring a pilot you authorize us and the processor to charge it for the pilot's compensation, the platform fee shown to you before you confirm the hire, and any cancellation or other fees under our Cancellation Policy. You agree to the processor's terms.
Funds are held and released to the pilot under the rules shown in the Platform, which can include holds while a cancellation, no-show or dispute is reviewed. If we offer paid plans, the plan terms and prices shown when you sign up apply. You are responsible for any taxes that apply to your use of the Platform.
Electronic records and signatures
You agree that we may give you notices and agreements electronically, and that your typed name is your electronic signature. Our Electronic Signature page describes this consent, how to withdraw it and what happens if you do.
Acceptable use and professional conduct
Deal honestly and professionally with pilots and our team. Do not post false, misleading or unlawful trips, impersonate anyone, harass others, or leave ratings and reviews that are untrue.
Do not interfere with the Platform or its security, use it through methods we do not provide, collect other users' information for purposes outside the Platform, or misuse content shared with you in confidence.
Intellectual property and feedback
FLTLVL410 owns the Platform, including its software, design and trademarks. You keep ownership of the content you submit, and you give us a license to host, display and use it to run the Platform and to show it to pilots.
If you send us suggestions or feedback, you give FLTLVL410 a royalty-free, perpetual license to use them to evaluate and improve the Platform.
Disclaimers
To the fullest extent the law allows, the Platform is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Although we verify certain credentials, we do not guarantee that pilots will apply or perform, or that information posted by users is accurate or complete.
Limitation of liability
To the fullest extent the law allows, FLTLVL410 is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue, arising from your use of the Platform.
Except for liability that the law does not allow us to limit, our total liability to you for all claims relating to the Platform is capped at the greater of the fees you paid us in the twelve months before the claim arose and one hundred U.S. dollars.
Indemnity
You will indemnify FLTLVL410 against reasonable defense costs and damages arising from your misuse of the Platform, your trip postings, your misrepresentations, or your violation of aviation regulations or other law.
Suspension and termination
We may suspend or end your access, or remove your listings, if you materially breach these Terms or the Cancellation Policy. Where reasonable we will warn you first, unless the risk requires faster action.
You may stop using the Platform at any time, and you can ask us to delete your account as described in the Privacy Notice. Sections that by their nature should continue, including payment obligations, disclaimers, limits of liability and indemnity, survive termination.
Governing law and disputes
These Terms are governed by the laws of the state in which FltLvl 410 LLC is organized and by applicable U.S. federal law, without regard to conflict-of-law rules.
You and FLTLVL410 agree to bring any dispute relating to these Terms or the Platform in the state or federal courts located in that state, except where the law gives you the right to bring it elsewhere. Before filing a claim, please contact us so that we can try to resolve the matter informally.
Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the date at the top of this page and, where the law requires, notify you through the Platform or by email. Your continued use of the Platform after an update means you accept the updated Terms.
Notices and contact
For questions about these Terms, or to send us a legal notice, email support@fltlvl410.com and include "Legal" in the subject line. We may send notices to you at the email address on your account or through the Platform.
